Choosing the Right Doctor

After a maritime injury, the first medical provider may be selected by the vessel, employer, cruise line, emergency service, or local facility. That initial treatment can be essential, but serious injuries often require follow-up with specialists who have the training and resources to evaluate the condition fully.

The appropriate doctor depends on the injury. Orthopedic surgeons, neurosurgeons, neurologists, pain-management physicians, physical therapists, psychologists, neuropsychologists, and other specialists may become involved. The key is to obtain care based on medical need rather than on who has the greatest financial interest in minimizing the claim.

For seamen, disputes can arise over whether the employer will authorize a particular provider or treatment as part of maintenance and cure. For cruise passengers, care may begin in the ship's medical center and continue at a foreign port or after the passenger returns home. Keeping a complete record of each provider and treatment recommendation helps maintain continuity.

Patients should describe symptoms accurately, ask questions about diagnosis and prognosis, and follow reasonable treatment recommendations. A medical record is strongest when it reflects the patient's actual condition over time rather than an attempt to use exaggerated or minimized language.

If an insurer, employer, or defense lawyer schedules an examination, the injured person should understand whether the doctor is a treating physician or an examiner hired for litigation. Those roles are different, and the patient should know the purpose of the appointment.
