How Long Does a Maritime Injury Case Take?

There is no single timetable for a maritime injury case. Some claims resolve within months, while serious, disputed cases can take years. The timeline is influenced by the medical course, the number of defendants, the amount of discovery, the court's schedule, expert issues, and whether the case is resolved by settlement or trial.

Medical stability is often one of the most important timing considerations. A settlement reached before the full extent of an injury is known may fail to account for future surgery, long-term restrictions, chronic symptoms, or loss of earning capacity. For catastrophic injuries, it can take substantial time before treating physicians can reliably describe prognosis and future care.

Complex maritime cases can also involve multiple companies with different roles. The employer, vessel owner, operator, charterer, contractor, equipment manufacturer, and other parties may each possess different evidence and assert different defenses. Coordinating discovery among several defendants usually takes longer than handling a straightforward single-party claim.

Court schedules matter as well. Once suit is filed, the judge will typically enter deadlines for discovery, experts, motions, mediation, and trial. Those deadlines vary by court and can be affected by continuances, medical developments, or disputes that require judicial resolution.

The goal should not be to make a serious case last longer than necessary, but speed should not come at the cost of leaving important damages unexplored. Clients should receive regular updates and understand the next major event in the case, what remains to be done, and why the timing matters.
